GENERAL TERMS AND CONDITIONS OF USE AND SALE (GTC)

Article 1. Identification of the Service Provider

LA BACLERIE, SAS with a share capital of 7,622.45 euros, registered with the Trade and Companies Register of Nantes under number 383 572 807, whose registered office is located at 10 rue de la Baclerie – 44000 Nantes (hereinafter “the Provider”), publishes and operates the website https://www.auvieuxquimper.bzh/ (hereinafter the “Site”).

The Site offers access to information about the establishment as well as the sale of gift vouchers giving access to catering services.

Article 2. Purpose and acceptance of the General Terms and Conditions of Sale

These General Terms and Conditions of Use and Sale (GTCU) govern access to the Site as well as the terms of sale and use of gift vouchers.
Any use of the Site and any order implies full and complete acceptance of these General Terms and Conditions of Use.

The Customer acknowledges having read this before placing any order.

Article 3. Access to the site

The Site is accessible free of charge to any user with internet access.

The user is responsible for the costs of accessing and using the telecommunications network.

The Provider reserves the right to suspend, limit or interrupt access to the Site for maintenance or updates.

Article 4. Services offered

The Site allows:

  • Consulting the map and information about the establishment
  • Buying gift vouchers

Gift vouchers can be used exclusively within the establishment, in exchange for catering services.

Article 5. Price

Prices are shown in euros, including all taxes (TTC).

They are those in effect at the time of the order.

The Provider reserves the right to modify its prices at any time, without affecting orders already confirmed.

Article 6. Order

The Customer selects a gift voucher (€25, €50 or €100), fills in the required information and confirms their order.

The customer can check and correct their order before final validation.

The order is considered final after payment.

A confirmation email is sent to the Client

Article 7. Payment

Payment is due immediately upon ordering.

Payment is made by credit card via a secure system.

The order is only validated after payment has been received.

Article 8. Delivery of gift vouchers

Gift vouchers are sent electronically to the email address provided during the ordering process.

They are considered delivered as soon as they are sent.

Article 9. Use of gift vouchers

Gift vouchers are valid for 1 year from their date of purchase.

They are only usable on site.

They are not eligible for any refund after partial or total use.

Article 10. Right of withdrawal

In accordance with Articles L221-18 et seq. of the Consumer Code, the Customer has a period of 14 days to exercise their right of withdrawal.

This right cannot be exercised if the gift voucher has been used.

The refund will be issued within a maximum of 14 days from receipt of the request.

Article 11. Liability

The Provider makes every effort to ensure the proper functioning of the Site and the proper execution of orders.

He cannot be held responsible:

  • Misuse of the Site or gift vouchers
  • From a malfunction beyond his control
  • Due to force majeure

Article 12. Intellectual Property

The content of the Site is protected by intellectual property law.

Any unauthorized reproduction or use is prohibited.

Article 13. Personal Data

The Provider collects and processes personal data in compliance with the GDPR and the French Data Protection Act.

The data is used solely for order management and customer relationship management.

The data is kept for a maximum of 5 years.

The Client has rights of access, rectification, deletion, objection and portability.

Article 16. Force majeure

The Provider cannot be held liable in the event of non-performance due to a force majeure event.

Article 17. Applicable Law

These General Terms and Conditions of Sale are governed by French law.

Article 18. Disputes

In the absence of an amicable resolution, any dispute will be submitted to the competent courts according to the rules of common law.
